Montlake Tour Terms of Service

These Montlake Tour Terms of Service (“Terms”) apply to your use of the Montlake Tour website located at https://montlaketour.com (“Site”) and the golf reservation services made available by Montlake Tour through the Site. The Site is operated by Pitchmark Inc., trading as Montlake Tour, with its registered office in Tokyo, Japan. Pitchmark Inc. facilitates bookings at golf courses in Japan for users through the Site, referred to as the "Service."

1. Acceptance of the Terms

Please read these Terms carefully, as they create a binding legal contract between you (“You” or “User”) and Montlake Tour (operated by Pitchmark Inc.). By accessing the Site or using the Service, you agree that you have read, understood, and accepted these Terms. If at any time you do not agree to these Terms, you must stop using the Service.

These Terms, along with any other terms and policies referenced herein, constitute the entire agreement between you and Montlake Tour. The Site is available only to users aged eighteen (18) or older. If you are under 18, please discontinue using the Site immediately.

If you make a booking on behalf of a group, you are responsible for sharing these Terms with all members of your group and are financially responsible for the booking.

2. Accuracy of Information

Montlake Tour strives to provide accurate descriptions of the services and products available on the Site. However, we do not guarantee that these descriptions are always complete or error-free. Montlake Tour is not responsible for any errors in the descriptions, prices, or availability provided by third-party golf courses. Details about your chosen golf course, including costs and fees, will be confirmed at the time of booking.

3. Price and Payment

Montlake Tour reserves the right to adjust the price of any booking before confirmation. Any reductions in price due to special offers after a booking is confirmed will not apply retroactively.

By making a payment, you agree to these Terms and authorize Montlake Tour to charge your card for the agreed amount.

Payments made via credit card may be subject to a processing fee that will be charged in accordance with Stripe’s current fee structure.

4. Cancellations and Amendments by You

All deposits and payments are non-refundable unless otherwise stated. If you need to amend or cancel your booking, you must notify us in writing. Any amendments are subject to our discretion and may incur additional fees.

5. Cancellations and Amendments by Us

Montlake Tour reserves the right to make changes to or cancel confirmed bookings. If we need to cancel your booking, we will notify you and either offer a full refund or assist in arranging alternative bookings.

6. Service Scope and Cancellations

Montlake Tour’s service is limited to assisting with finding golf courses and making tee time bookings. Once your booking is confirmed, our service concludes.

We do not provide refunds for our service if you decide not to play. If you choose to cancel or fail to show up for your reservation, you are fully responsible for any costs incurred.

Each golf course has its own cancellation policy, and you are required to adhere to these policies. By using our service to book courses, you agree to comply with the golf course’s cancellation policies. If a cancellation fee is charged by the golf course, we will send you an invoice, and you are responsible for paying the fee. Montlake Tour is not responsible for any additional charges imposed by the golf course due to cancellations or no-shows.

7. Travel Insurance

Travel insurance is highly recommended for all customers to cover potential risks such as cancellations, medical expenses, and lost baggage. Montlake Tour does not provide travel insurance, and it is your responsibility to ensure that you are adequately covered.

8. COVID-19 Policies

If travel restrictions due to COVID-19 prevent you from attending your scheduled booking, you may be eligible for a reschedule or a credit for future use. If your destination is not affected by restrictions, our standard cancellation policy will apply.

9. Special Requests and Medical Needs

Any special requests, including those related to medical conditions, must be made at the time of booking. Montlake Tour will try to accommodate your requests but cannot guarantee they will be met.

10. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, and software, is the property of Montlake Tour (operated by Pitchmark Inc.) or its licensors and is protected by intellectual property laws. You may not reproduce, modify, or distribute any content from the Site without our permission.

11. Limitation of Liability

Montlake Tour is not liable for any losses or damages arising from the use of the Service, including missed or unused services, cancellations, or changes to bookings due to force majeure events such as natural disasters, pandemics, or other unforeseen circumstances.

Montlake Tour is also not responsible for any cancellation fees or penalties imposed by golf courses, which are the sole responsibility of the user.

12. Governing Law

These Terms are governed by the laws of Japan, without affecting any mandatory consumer rights available to you under the law of your country of residence. Any disputes will be resolved in Tokyo District Court.

13. Modifications to the Terms

Montlake Tour reserves the right to update these Terms at any time. Changes will take effect immediately upon being posted on the Site. Continued use of the Service after changes to the Terms constitutes your acceptance of the updated Terms.
